Pet Memorial Garden ("the Service", "we", "us") is a software-as-a-service platform that allows users to create and maintain online memorial pages for deceased pets. The Service is operated by a registered software company in the United Kingdom.

By accessing or using Pet Memorial Garden you confirm that you are at least 18 years of age (or have parental consent if younger), that you have read and understood these Terms, and that you agree to be bound by them.
If you do not agree to these Terms you must not use the Service.
You are responsible for maintaining the confidentiality of your login credentials. You must not share your account with others or use someone else's account without permission.
You agree to provide accurate and truthful information when registering and to keep your details up to date.
We reserve the right to suspend or terminate accounts that we reasonably believe are being used fraudulently, abusively, or in breach of these Terms (see Section 8).
Each memorial page is associated with a specific subscription or purchase. A standard memorial subscription costs £12/year (billed annually). Subscriptions auto-renew unless cancelled before the renewal date.
If a subscription lapses, the memorial is hidden from public view but your data is retained for a period of 90 days. After that period we may permanently delete the memorial and all associated content.
Forever Memorial purchases permanently remove the annual renewal requirement for a single memorial. This is a one-time payment and applies to that memorial only.
You retain ownership of all content you upload (photos, text, inscriptions). By uploading content, you grant us a non-exclusive, royalty-free licence to store, display, and deliver that content as part of the Service.
All payments are processed securely via Stripe. We do not store your card details.
Prices are displayed in British Pounds (GBP) and include VAT where applicable.
Subscriptions: Recurring subscriptions (yearly or monthly) may be cancelled at any time from your account settings. Cancellation takes effect at the end of the current billing period — you will not be charged again but no partial refund is issued for unused time.
One-off purchases (Memory Book, AI Portrait, AI Poem, gravestone upgrades, QR Plaque, etc.) are non-refundable once delivered or generated, unless the item was faulty or not delivered due to an error on our part.
QR Plaques: Physical products are despatched within 5–10 working days. Refunds or replacements for damaged items must be requested within 14 days of receipt by emailing support@petmemorialgarden.co.uk.
To request a refund for any other reason, please contact us and we will consider each case on its merits.
You may only use Pet Memorial Garden for its intended purpose — creating and maintaining memorial pages for deceased pets. You must not:
Visitors can leave tribute messages, virtual gifts, and condolence book entries on memorial pages. You (as the memorial owner) may moderate, hide, or delete content on your own memorial pages at any time.
We reserve the right to remove any user-generated content that violates these Terms or that we consider harmful, offensive, or inappropriate. Content may also be removed following a report by another user.
We operate a reporting system. If you see content you believe violates these Terms, please use the report button. False or malicious reports are themselves a violation of these Terms.
We take abuse of the platform seriously. We may, at our sole discretion, warn, suspend, or permanently ban any account that:
Banned accounts are suspended immediately. Content on memorials owned by banned accounts may be hidden or removed. Any active subscriptions associated with a banned account are cancelled without refund where the ban is a result of Terms violation.
We maintain a list of banned email addresses. Attempting to re-register using an address on this list, or using a different email to evade a ban, is a further violation of these Terms.
If you believe your account was suspended in error, contact us at support@petmemorialgarden.co.uk with "Account Appeal" in the subject line. We will review and respond within 5 working days.
The Pet Memorial Garden name, logo, design, software code, and all original content created by us are protected by copyright and other intellectual property laws. You may not copy, reproduce, modify, or distribute any part of the Service without our prior written consent.
Our collection and use of your personal data is governed by our Privacy Policy, which forms part of these Terms. Please read it carefully.
The Service is provided "as is" and "as available" without any warranty of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or completely secure.
While we take every care to maintain the availability and integrity of memorial pages, we cannot guarantee against data loss caused by hardware failure, third-party service interruption, or events outside our control. We recommend you retain copies of important photos and text.
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from your use of or inability to use the Service.
Our total liability to you for any claim shall not exceed the total amount paid by you to us in the 12 months preceding the claim.
Nothing in these Terms limits or excludes our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
We may add, modify, or discontinue features of the Service at any time. We will endeavour to give reasonable notice of significant changes. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
We may update these Terms from time to time. The "last updated" date at the top of this page will change. Where changes are material, we will notify registered users by email. Your continued use of the Service after notification constitutes acceptance of the new Terms.
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
